What might be worth considering in the assigning of penalties is for a jury to determine the degree of altruistic intent by the accused during deliberations on a scale of plus or minus six.  The plus or minus six is arbitrary, but based on the idea that there are six covenants in the Constitution  and that a jury might need to decide whether some predatory instinct was at work in the act or whether it was an act of compassion to prevent suffering by any.  The idea is to balance the act of life and/or death with Justice and liberty for the perpetrator of the act.  It has been very difficult for people to make such decisions about others, so some scale involving the degree of altruism is needed.  It should not be for a national level state to determine life or death; only citizens near the act should make the decision.
